Legal Question in Landlord & Tenant Law in Florida

I have a tenant without lease (month to month), she is always complaining about everything. Can I send her a letter informing her that starting January 1st, 2010, I will only be responsible for roof repairs and structure, that I will not repair the air condition or any pluming repairs and give them the option to move if they want to. Last month and this month I have to paid more than $400.- in air condition inpections and cleaning the coil because they don't use the air condition filter. Besides that they are selling fish in the property, they have fawls without authorization and a dog.

Lesly Longa Longa Law P.A.

Does the lease prohibit animals/dogs? You could evict your tenants for breaching the lease or for failure to pay rent, but as a landlord you have certain responsibilities to maintain the premises under Florida law and cannot change the terms of the lease now as retaliation for these repairs. Check Chapter 83 of the Florida Statutes and the summary of law at: http://www.800helpfla.com/landlord_text.html
