Legal Question in Landlord & Tenant Law in Florida
A tenant paid to the court during his eviction $1000, which covered a bad check he had written to me for the rent. When calling the courthouse after the eviction took place to ask about return of the $1000 they said I would have to get tenant to sign release of the money to me or file a motion. Obviously after you evict someone, they are not happy to see you again. What type of motion would I file--a name for it please? Thank you.

A Motion to Disburse Funds in Registry to you. Was this issue dealt with by the Court? It should have been. If not, the Motion alone may not be sufficient. The former tenant needs to get a copy.
