Legal Question in Landlord & Tenant Law in Florida
We have a tenant who also rents a storage unit from us in the building's garage area. During June heavy rains, the street in front of the building got flooded and water came in the garage and wet two pieces of luggage they had sitting on the concrete floor of the storage unit. . This is a new building (about 1 year old). Their property insurance will not cover their claim.
The building's insurance does not cover property. THey now are deducting $500.00 from rent money this month for the loss of their luggage. Is this legal?? Are we as owners of the condo and the storage unit liable ?. We are considering returning their partial check and not accepting anything but the exact rent money.. What is the law pertaining this? Thank you

Until a judge adjudges you responsible, they have no right to deduct rent, however, this may avoid a small claims lawsuit. Get a release from them.
