as a tenant what rights do i have if the landlord does not pay there HOA fees?
Can i be evicted?

Your rights are set forth in the lease. Generally, a tenant cannot be evicted if the landlord does not pay the association fees; however, certain services or access to facilities may be at issue if the bylaws set forth some right to withhold them for non payment. I suggest you look to your lease and if subject to the HOA, you should ask the association what the bylaws state. If they say you can be evicted or lose other rights, request a copy of the relevant sections for your review. Good luck.
