Legal Question in Landlord & Tenant Law in Florida
Tenant right on a *stalker *
I am a female and i live alone in a south beach apt. For the past 3 weeks there has been a guy looking into my window and my neighbors. Police keep coming out but don't catch him. The front gate and the side doors that leade to the alley where my bedroom windos are do not lock. The management company says it is not their problem and hang up on me! Can i break my lease? Have police reports and witnesses

If you can prove it, you can follow the procedures in FS 83 to have the problem corrected or terminate.

If you do not agree, then stop right here, and do not read any further.
Since I do not know the landlord or the management company, I cannot give any legal advice as it could be a conflict of interest for me. I would suggest that this is not a problem with the managment, however, but rather a police matter. You need to keep calling them until they resolve the problem. While not doubting your honestly, if every person could simply say that they have a problem with an unsubstantiated crime and that would give them a legal right to break a lease, then there would be no point in having leases as they would be unenforceable. Also, you should put covers or shades on the windows so that nobody could look into your apartment as most people do.
