Legal Question in Landlord & Tenant Law in Florida

My tenant's lease was up and he asked for a 2 month extension. I granted it. He did not pay the 2nd month's rent and told me to use the security. Meanwhile, he left the carpeting soiled by an unauthorized pet. He painted the rooms which were white, a dark brown. Isn't it true that if the landlord does not like the color, the tenant must repaint it the original color at the tenant's expense? Thank you

Your written lease, if any, would control the agreement subject to your novation at the end of the lease. If painting the walls was allowed without consent, you may be stuck. If painting required your consent and you did not agree, than you may have a claim. The pet damages are likely ones which you can collect. If you really agreed to use the security for rent than you would have to sue him for the damages. If you still have the security and did not agree you can impose the statutory lien and notify him. You would still have to sue for the additional rental that may be due. Next time, I would suggest you get legal advice before making the decision you made above.
