Legal Question in Landlord & Tenant Law in Florida
Tenants
I live in FL, I am getting evicted from my appartment for noise, I am up to-date with rent, and I am in a lawsuit against the apartment for another situation, my question is do I have to pay the remainder of the rent??

Re: Tenants
No, not if you will be evicted for noise. If you're going to be evicted anyway, why pay rent? If you think you'll win the noise case, you must pay the rent, or, obviously, you'll be evicted for non-payment of rent.
One word of caution, though: if you don't pay rent for the time you occupy the apartment, they may sue you for the time you actually lived there. But you don't have to pay rent for the time you don't live there because you've been evicted.
