Legal Question in Landlord & Tenant Law in Florida
I have tenants in my rental property and their lease has run out. Do I have to evict them to get them out at this point if they won't leave voluntarily?

Depends on what your lease stated - did it give them the option of staying on a month to month basis?

You don't have to evict them yet, but you have to give them proper written notice that you want them to vacate and that you are terminating their tenancy. Since there isn't a lease anymore, the amount of notice you have to give will depend on how they pay you (monthly, weekly, etc.). This is under Florida Statutes 83.57, and you can see that information on this site: http://www.800helpfla.com/landlord_text.html. Regards,
