Hello, I am in need of someone to help me. The thing is we just found out we have TOXIC BLACK MOLD in our air conditioner. Our landlord is refusing to fix that, as it has not been fixed or replaced in 16 years as long as this place has been built. The landlord had someone come out on the 26 of Sept. The guy said he could condemned the house right now! Then the landlord wanted a second opinion and brought someone out Sept 27. The same thing happened. The landlord told my mother, the one who is renting the house ( i live with her also ) that she has to wait and see if she can find a better price because, she does not want to pay 4,000-5,000. So till this day October 16 2012 they have not fixed it. My mother with held the rent on October 3rd 2012, because the landlord would not fix this or any other thing in the house we had told them about. Also on that day we told the landlord we are moving out, as to not fixing a thing in the house, and the mold witch can kill someone in the house hold.So on October 12 2012 we got served with a eviction notice saying the landlord wants his money and more! I have a 15 month old daughter living here and they will not do a thing. Is there anything we can do? Can we be evicted? Do we have rights also? Or can we not do anything? I live in the state of Florida

If you were served just a notice - stay until you get the actual eviction with a summons from the court. It will give you the options you are looking for. Place the rent in the registry of the court until the case is settled.
