Legal Question in Landlord & Tenant Law in Florida
After three weeks of tenancy my tenant died, her adult sons entered the house thru a window, I called the LEO for trespassing, the next of kin were told to contact me or my agent to have access to the house. The officer went to the house and called me, he suggested that I allowed them to stay considering the familly lost so I allowed them to stay until the end of the payed rent term (7 day) . On the 8th day the older son called me and said he want to rent the house. I told him no, (discovered he was arrested 8 time in past year ) he is now claiming to have inherited his mom's lease and will not move out. What kind and how long of a notice do I give him?

When your tenant died, the lease died with her so there is no lease to inherit. Call the police and have the son tresspassed. You owe him no notice. If you would like to consult further on the matter, call my law office at (813) 951-6187 or email me at [email protected] to schedule an appointment.
