Legal Question in Landlord & Tenant Law in Florida
i wrote my landlord a check and asked him to just hold it before deposit the same day for me to be able to make sure funds would be there. instead i got a three day notice. he was still holding my check and on the third day of the notice, when i told him to deposit, he never replied. now i am served with an eviction. He not only still has my check he didnt cash but my last months rent and security. not sure what i can do in this situation. if he wanted me out why not keep last months rent and give me 30 days? let me make it clear these problems only occur because everytime he comes to get the rent he wants to come in and look around and he feels free to look where he wants. This last time i had it, he picked up my check from under my mat because i was not going to be home. but texted my phone that my car was outside and wanted to come in, i wrote back that i was not home. Three day notice the next morning, but he didnt bother to cash my rent and like i said i am now being evicted and he still has my last rent and security.

He has to serve you an eviction package - when you get it comply with what it says and get a hearing date. Tell your story in court
