Legal Question in Legal Ethics in Florida

adequate excuse to miss subpoena

Please help...A lawyer left a subpoena for deposition at my house while i was out of the country. Upon arrival home I contacted the lawyer and told him that I couldn't attend on a friday as i couldnt afford to miss work. The lawyer then rescheduled for november 10'th. I told the lawyer i would be working out of the state on that date and after providing a written letter from my employer he excused me from the deposition. This morning november 7'th i received a letter from the lawyer commanding me to appear in florida (at my own expense approx. 1500 dollars) on November 10'th. He states that his previous excusal is no longer valid and will file for contempt charge if i do not attend..........

Any immediate help is greatly appreciated

Re: adequate excuse to miss subpoena

It is not clear where you are from. If you are not in the state of Florida, then a subpoena cannot validly command you to appear here. If you would give me a call or e-mail with the details, I would be happy to discuss the matter with you without charge.
