Legal Question in Legal Ethics in Florida

The bar manager at a restaurant chain encourages his employees to pour a well (less expensive) drink when a top shelf or premium drink is ordered. The guest pays for the expensive drink and is told that is what they are being served when it is actually something else. Is this legal?
