Legal Question in Legal Ethics in Florida
I bought an animal under a health guarantee that if the animal dies within one year as a result of a congenital defect it would be replaced. Unfortunately the animal DID die, and I would like to know if a replacement would be expected as first available, or as the seller decides they can afford to loose a sale? They have a new litter on the ground, and I was expecting one of this litter--they have no deposits on any of the litter at this point. Now the seller is claiming I would have to wait until possibly up to a year as they can't afford to replace it at this time and loose the sale price. What can I do? If it makes a difference, the seller is located in Ohio.
