Legal Question in Legal Ethics in Florida

My company has a written policy you can retire at 50yrs old and 20 yrs with the company or 55yrs and 25yrs with the company. I will be 50 in Sept and have 25.5yrs with the company. Is it age discrimination i cant retire at 49.5 when i have over 25yrs?

The retirement rules must pass Statutory tests associated with ERISA. If the standard as set up passes that test and is applied non discriminatorily, then it is not violative of the rules.
