Almost a Desperate Divorcee

I retained an attorney in Mar.07 to

handle my case.I have been married 27+years and have a 15 yr

old son.I supplied my attorney with

all the mandatory discoveries.My

soon to be ex was served in May

to turn over his first discoveries,he

did not until Oct.07.I've never had

to have an attorney before don't

know what they are to do.I want

to know has this attorney caused

any prejudice in my case?Should my lawyer have taken legal action against my future ex? We are for

mediation Nov 5,07,1:30.I don't know what can be done.Can I take

action against my attorney if he

causes me to have a loss? I know

this is a50/50 state,but there is

a couple things that might have to

go before a judge,and I'm running out of funds. I am a stay at home

daycare provider.Please give me

some direction to try before I make

a terrible mistake.I retained this

attorney because I don't know

Family/Divorce laws. HELP!!!!!!!!!!!!!!! I know we have

time limits on our discoveries.My

attorney didn't enforce these at

all.

It does not appear from your post that the delay in getting discovery from your ex has hurt you. It is not terribly unusual for discovery to be late, although 5 months is really late. Since you have the information prior to mediation there does not seem to be any harm caused by the delay. You should speak with your lawyer about your concerns to get his input.
