Legal Question in Legal Ethics in Florida

My ex husband and I have been trying to find out what happened to monies garnished from his wages and never paid to me and our kids!! It is now almost 4 yrs since he was employed there and the courts have left the burden of proof to him and his attorney. He presented paystubs but the courts requested records from the corp. Upon recieving my copies I noticed MANY mistakes and still am unsure as to whose at fault for sure...but the company mailed us not only my ex husbands records and his private information, but also his co worker( at the time) private info and child support info.!!! They admitted the mistake when I called them and I then further asked about other small things I noticed. The State ID # changes in the midst of employment and yet I received sporatic payments from eithier labled " ID" So therefore that must not have bore much weight on weather that affected me receiving the money.

So the comp now tells me they have another company that handles payments once they are garnished....that " they " infact send them to Fla and it's thier ball. What can I do? I am tired of waiting and people making mistakes that are potentially awful! I still have record of the other mans social security number, child support info.,...etc! Who is responsible for our waiting and suffering not to mention my ex husband not getting creditied for his efforts. Can we sue the company for their unprofessionalism.....and I am sure they are the reason for the monies being missing! I need help. This is In Fla and would take like to talk to a lawyer paid upon winning. Who ever is at real fault should be responsible to compinstae our suffering and waiting and trying times.

You might have an action against the company but this doesn't sound like a case an attorney would take on a contingency basis. You may need to hire an attorney and be willing to pay on an hourly basis if you are interested in pursuing an action against the company. You also haven't given us any indication as to how much they failed to disburse and the amount of the overall claim.
