Legal Question in Legal Ethics in Florida
Hi, Some months ago I wrote a letter of recommendation for someone I work with. Since that time I realize that I do not want that person using my letter to get a job as we work in a small community and he is definately not the employee I originally thought. I don't want to give specifics but I would like to notify some other members of our field that if he is using my letter that I am rescinding my recommendation. I do not want to be accused of libel but I thought perhaps I would send an email to some of our peers stating that if he applies for a job with their company that I have rescinded my recommendation. Again, no details, just that I rescind my recommendation. Could he attempt to sue me for libel if I do nothing else except to say I rescind my recommendation?
(example; To whom it may concern, You may have an applicant at your company by the name of "John Doe". If Mr. Doe presents to you a letter of recommendation from myself please be advised that I have chosen to rescind my recommendation. Sincerely, L. Rod.)

That is not libel, but is it worth the fuss? You might just tell the person not to use the letter. Anyone that actually wants to hire him and values the letter would call you. I would just tell the former employee not to use the letter because if contacted, the recomendation would not be favorable.
