Legal Question in Legal Ethics in Florida

Paralegal

I have only the internship portion of my degree to have an A.S. in Legal Studies. I have worked for the State Prosecutor for over a year now in criminal law, but am well versed in all others (i.e. Family Law, Probate, Contracts, etc.)

I understand I cannot give legal advice, but want to start a legal forms type business generating legal forms for individuals and helping them file them in the court systems. Only paperwork, no legal advice (of course) at all! I am also a Florida Notary.

Can I do this in my state without being a certified paralegal and it be ok?

Being a certified paralegal (which is only a recent creation by the way) has nothing to do with your ability to do what you envision. The question is whether you are practicing law or not. You cannot, for instance, help people fill out forms, but you can sell forms. You cannot provide advice. There is a very very fine line and if you contact the Florida unauthorized practice of law committee with the Florida Bar and they can give you the case citations. The Florida Supreme Court has made some very specific rulings about this area.
