Legal Question in Medical Malpractice in Florida

Do we have a case?

The patient had surgery, developed an infection, and later was hospitalized. The attending doctor performed labs, resulting in Staphylococcus aureus (MRSA), a recommendation for debridement was intervened by the original doctor. After discharge, the original doctor ignored the recommendation to repeat the labs, ignoring the infection, and the risks. After 1 long painful year, an abscess formed, developing pus. The patient’s original doctor finally decided to do a debridement. Today, the patient lost quality of life, reduced lifestyle, disfigurement, chronic pain, and long-term medications.

Perhaps. No one could possibly tell without taking a look at the patient's medical records. The abscess developing a year later is suspicious and showing that it was related to the original procedure or should have been corrected and avoided earlier. That would depend on what the records after the procedure and before the abscess formed reveals. In addition, if the patient has fully recovered, it is unlikely that the case could be economically pursued to produce a recovery of any significance.
