Dad Died from hospital born bacteria

trying to find out if my mother has a case against the hospital she was married to my dad for 22yrs. then they divorced and were seperated for 3 yrs. got back together and have been living with each other for about 9 yrs. but never remarried. I keep hearing that she wouldn't be able to have a case because she wasn't married but my mom was definetely a dependent of my father and she relied on him. I am just concerened for my mother and upset at this hospital for letting this happen to my dad. Please help my mother. Thanks

Technically, she has a case because of the dependency, but only for that amopunt. In almost all cases, however, the cost to bring a medical malpractice case would never justify pursuing a dependency only case.
