Legal Question in Medical Malpractice in Florida

Malpractice

My wife is an occupational therapist. See is a CDRS and recommends if people are qualified to drive if referred to by a doctor and traines people to use hand equipment. We currently are working on getting insurance. She works for a hospital. What would happen if someone tried to sue her before we get the insurance? Can they go after homeowners insurance or go after our house/assets.

Re: Malpractice

You would not want that to happen. Having insurance is a must to protect you.

Re: Malpractice

If your wife "works for", is an employee, of a hospital than the hospital's insurance will cover her. In Florida, your home is exempt from forced sale by creditors.

Your sued for her professional negligence, your home owner's coverage will not apply.
