Legal Question in Medical Malpractice in Florida

I had a partial knee replacement 15 months ago..although I have full range of motion my knee is still painful and numb on one side...it is still painful and have to take medication daily...after nerve conduction test it indicates nerve damage...do i have a case for suing

To know if you have a case of medical negligence in Florida would require having the records reviewed by a surgeon with the same specialty and perhaps other physicians or nurses. If the reviewing health care providers found the standard of care was violated or that there was reason to believe standards of care were violated, you could file a lawsuit. As a practical matter, due to the expense involved in pursuing medical negligence cases and the limitations on recovery under current laws and in the current political and philosophical climate, many lawyers accept medical negligence cases only when damages are quite catastrophic, e.g, death, amputation, paralysis, etc. Your case may not fall into the catastrophic category.
