Legal Question in Medical Malpractice in Florida
Staph Infection
I got a staph infection while having shoulder surgery in an outpatient clinic. As a result, I had to have another surgery to clean out the infection, which included removing all the sutures resulting in having a third surgery to redo the first. I have already used all of my vacation and sick leave because of this, and facing yet another surgery and recovery period. What are my options for compensation?

I guess you are wondering if you have a medical malpractice case.
Staph infection cases, as is with most infection cases, are difficult cases to prove in terms of negligence. Germs are all around us, especially in surgical centers and in hospitals. First, you would need to prove that the center failed to have the proper protocol and or failed to follow it re preventing infections. You then need to prove that its failure to provide and or follow the procedures caused the infection. The more likely approach is to see if the doctor was negligent in his discovering the infection and how he treated it. The next question is damages: does the injury make the case worth pursuing.
