Legal Question in Medical Malpractice in Florida

tubal or ectopic pregnancy after tubal ligation

My doctor performed a tubal ligation on me to prevent me from having any children. I ended up getting pregnant anyway and had to undergo an emergency surgery. The pregnancy was tubal and ruptured causing me to internally bleed into my belly. They had to do surgery to remove both tubes, any pregnancy remains, and drain out over a liter of blood. I want to know if the doctor that did the tubal ligation can be held liable for this happening to me?

Yes -- but if you fully recovered and are left with no significant injury, the expense of litigation will outweigh the probable recovery. The Republican legislature in Florida has enacted special protections for doctors to protect agains so-called "frivolous" lawsuits. As a result, vistims of medical malpractice frequently have no recourse.
