Legal Question in Personal Injury in Florida

On 98/27/2007, while livingin Virginia Beach, Va. 23464, I fell and smashed my right knee hard into the cement street. I immediately found an Orthopedist/surgeon, and began receiving treatments. On 06/25/2008 I moved to Barefoot Bay, Florida 32976. I sought out anb Orthopedist/Surgeon. He found that I had a torn Medial Meniscus, plus DEAD bone floating around my right knee. I had right Total Knee Relacement on 01/28/2009. After I was well enough healed my surgeon recommended Physical Therapy, both at the facility & at home. I went back to my Surgeon because my right knee is totally deformed, even after almost 7 months of Physical Therapy at home & 2 Facilities. The surgery looks like it was preformed with a very dull serated kitchen knife, plus after removing the ace bandges I was wrapped in from my right ankle to above the knee,it remains totally discolored. My surgeon suggested getting a second opinion. A blind surgeon couldn't fix this disformed right leg, plus, the leg will NOT straighten out. Do I have grounds for any type of medical Law Suit?

It depends. The real issue would be whether any doctor did something that was below the standard of care. In other words something was done that a reasonably prudent surgeon would not have done. From a personal standpoint given that you continue having problems a second opinion would not be a bad idea. With the second opinion you may be able to determine what the cause of the problem is and with that a lawyer would be in a better position to figure out whether or not there is a case. Remember that under Florida law there is a 2 year statute of limitations for bringing a medical negligence action.
