Legal Question in Personal Injury in Florida

assault

I was physically assaulted by a family member while visiting in a state other than where I live. I suffered a broken bone, knee damage, bites and other injuries. The police were called & I did not press charges @ that time. I was taken by ambulance to an ER & then left from there for my home state, as it was not safe to return to their home. The state it occured in does not automatically arrest the person who attacked even though the injuries were there. My question is: Can I press charges in a civil court so that I can have my medical bills paid by the abuser? I have no insurance & will be liable for large ER, ambulance & medical bills for injuries in the state it occured & my home state.

Re: assault

Yes. You may sue for a civil assault. It is often quite difficult to collect, however, from someone without insurance. You will almost certainly need to sue in the state where the attack happened. Good luck.
