In Florida assault occurs when a person, by word or act, makes an unlawful and intentional threat towards another person in order to create a well founded fear of imminent violence or harm. That is the criminal standard. The civil definition is pretty similar but with a lower standard.
So I think there answer to your question is that, it could be in the creative legal argument sense of the word. But it is probably not.
