Legal Question in Personal Injury in Florida
auto trauma
We were rear ended at a high rate of speed. Car is totalled (already settle on car). I had my 9 year old and 2 year old with me. They were looked at immediately at the scene and at their ped. office checked for injury, other than some bruises and soreness, they sustained no serious injury. But my 9 year old is now terrified every time we get in the car, she becomes pale, withdrawn, constantly looks back to see if anyone is going to hit us. She has nightmares and clung to me for weeks after the incident. I sustained a concussion, popped out my shoulder, and did something to my neck, I am still seeing a chiropractor. My question is will they take her (my daughter) emotional distress into account? How do I present this to them? Should I seek counseling for my daughter? I don't want to make it worse by dwelling on it, but I am saddened to see my usually sunny happy daughter so uncharacteristically withdrawn and fearful. If we take a long ride anywhere, we have to pull over and let her out to calm down several times. How should I handle this with the insurance company?

Sorry to hear about your accident. Yes, if you can support her claim for post traumatic stress disorder (through medical records) then the ins. company should consider this claim as well.
