Legal Question in Personal Injury in Florida

Bar negligent in serving alcohol to a drunk person - killing my son

After patrons requested no more service to a patron - a bartender relied "As long as he's paying - I'm serving". He proceeded to leave after more drinks and less than one mile later - ran head on into my sons car and killed him. What is the best way to make the establishments realize what they are doing? How do I go about trying to make them accountable and responsible for their actions contributing to murder?

I am so sorry that you have lost your son in this senseless situation I also have a son; 25 years old. I am concerned about his safety in Kosovo, every day.....You may have a damage claim against the bartender's employer. DO NOT sign any release without further professional assistance...JMC

You should definitely consult with an attorney to preserve your rights. You have a claim under Florida law, but there are some tricky issues. If you e-mail me, I would be happy to discuss the situation further and to recommend an attorney in your area.

I would strongly encourage you to contact a local personal Injury attorney. You should not settle with the drivers insurance carrier until any Release or other paper work is reviewed. Sometimes a release of the driver will extinguish a claim against a third party. Good Luck.

There is a law called the Dramshop Act which holds tavern keepers vicariously liable for the injuries which their drunk patrons cause...when a few conditions are met. This is something you need to discuss with an attorney, I will be more than happy to get more of the facts from you if you want.
