Legal Question in Personal Injury in Florida

My brother was hit by a car and smack into another car while he was bicycling in Tampa, Florida last week. He is in a coma and has had three operations on his pelvic area. We just found out from the attorney we obtained for counseling that the driver that initiated the accident had borrowed the car she was driving. She was not charged yet, and from what I was told, she was going 45 m.p.h. to beat the light and the cars ahead of her. She admitted she wasn't paying that much attention to traffic ahead of her. My brother, according to witnesses, never saw the accident coming. We, his sisters, and his brother, are concerned about the long term hospital and rehabilitation stay for my brother. He shouldn't be in this mess. Someone needs to pay for his hospital and rehab. and he should get money in his pocket to start over in life. He is 49 years of age as of today, October 23, 2009.

If you (or your brother) have retained an atorney, you should contact him for answers to these issues. If you have not contacted a lawyer, please feel free to e-mail or call. The first thing to determine is whether the driver that caused this accident has insurance and whether your brother has Uninsured/Underinsured Motorist coverage. The geniuses we keep sending to Tallahassee have failed to require drivers to carry insurance to protect those that they hurt. You need $1,000,000 to operate a merry go round, but not a penny of bodily injury coverage to operate a car. Go figure!

Retain counsel immediately who will investigate all aspects including medical, fault and insurance. I handle these type of cases. Good luck.

I'm very sorry to hear about your brother. You need to contact an attorney right away who is experienced in this area. In particular, you should look for someone who is board certified in civil trial law, as are the attorneys in our firm. There are a number of different issues regarding who's responsible and what insurance coverage applies. We offer a free consultation, and would be happy to discuss the situation with you.
