Legal Question in Personal Injury in Florida

Civil Procedure

My client was sued and represented by an attorney hired by his insurance co. Prior to that case settling, he file suit against Plaintiff for his injuries from same accident. Defense is claiming res judicata/compulsory counterclaim. Release did not waive his claim. Are they correct?
