Legal Question in Personal Injury in Florida

I was having coffee outside of a coffee shop, (a International coffee brand franchise) seating at their outdoor table 9-28-2015, there was a unlicensed & uninsured painter hired by the coffee shop using aerosol paint for the shop owner, I was sprayed with the aerosol paint by accident. I needed 911 assistance and was taken to the hospital with congestive heart failure, admitted for a few days. The shop owner�s insurance company claims there is a �pollution exclusion� to the policy.

I'm sorry to hear about this incident. The store's insurance policy may not cover this incident. However, the store itself may be personally responsible for paying for your injuries and medical bills. Did you have a history of heart problems before this? Did you just inhale the fumes or were you actually sprayed with the fumes?

Their disclaimer sounds ridiculous and can be challenged. You may still pursue the store. The issue will be whether you can prove the incident caused your hospitalization and how serious it was.
