Daughter injured at her employment
My daughter was injured at her job. There was no adult supervision. No one called 911. The owner of the business did not even know anything had happened until the next morning when I called. When I called, he told me to let him know of any out of pocket expenses we incurred. My daughter ended up having 2 surgeries and lots of PT and had to wear a brace for several months. We are retired military and most of our costs were covered by Tricare. However, we do have out of pocket expenses, such as loss of work for us, loss of work for her, deductables, plus the pain and suffering for my daughter as well as the parents. Workman's comp was not utilized. In fact, the employer never even offered it. I am planning to write him a letter requesting $5000. $2500 for my daughter directly for her pain and suffering. $2500 for my husband and myself for our mental pain and suffering, as well as out of pocket expenses and lose work time. We were not compensated by our employers. My daughter has app 90% use of her arm and this is how it will be for the rest of her life. Are there any websites that have laws regarding this? Especially the fact that there was no adult on the premises? Thanks in advance.
