Legal Question in Personal Injury in Florida

Defamation of character

My husband's ex-girlfriend is the mother of his 2 year old son. Almost every time we have visitation with the child, the mother takes him to the emergency room and claims that we have given the child drugs. The mother then requests a drug panel be given to the child. This has happened several times now and she has no eveidence to back up her allegations. She calls HRS who comes to investigate our household, etc. This has been going on for a year and I am sick of it! Can I sue her for libel or slander? Are there grounds for a lawsuit? If you think so, then I will hire an attorney because this needs to be stopped. She tells everyone that will listen to her and I want to prove a point to her. After all, we have 16 more years of shared parental responsibility with her. Please help me. Thank you very much.

You cannot prove a point to a person like this. Your husband selected a real nut job to have a child with. This is how she operates in order to discourage the relationship. Hopefully the case workers will come to know her and will leave you alone. Dont be surprised by other cruel actions such as planting drugs, reporting fictitious assaults, moving across country with the child.Best advice: PRAY.

Your husband and you may have legal options to short-circuit the ex-girlfriend's despicable behavior. You need to consult with an attorney in person, not by cyberspace, to discuss the facts in more detail, learn what options may be available, and to determine whether you and your husband want to pursue formal legal action, which can be a costly proposition.
