Legal Question in Personal Injury in Florida
I had developed terrible low back pain recently and thought it was simply strained And would go away. About 2 months later the Dr. I saw for this did an mri and found I had an acute lumbar5 fracture !! I was shocked and couldn't pinpoint when it happened. I subsequently recalled to my husband that I remember it happened on a trip we took in a rented Rv that was sub-par at best and the electric steps malfunctioned when I went to step out and fell flat on my back. We even complained of this to the Rental Co. Who were aware of this issue yet never fixed it. I have racked up over $17,000 in medical bills and treatment is just beginning! ! Do you think I should call an attorney? Do I have a case? This is just a cursory summation btw.

You have a difficult case to prove. If this "incident" occurred some time ago, and you didn't seek medical attention at the time, and you only recently developed back pain from a fracture, and you waited another 2 months to get treatment, it will be hard for a jury to connect the RV defect to your fracture, and find the rental company liable.
You should certainly call an attorney, but be prepared that a lawyer is not likely to file suit and pursue your claim on a contingency fee basis. You may have to pay for her time and filing fees and costs up front, if you decide to pursue legal action against the RV leasing company.
See a lawyer who does personal injury work and who tries cases in your area.
Unless the accident was reported, I doubt it.
