Legal Question in Personal Injury in Florida

My direct neighbor assaulted me with punches in response to complaints I filed with the landlord. I have been complaining for the last couple of months about the neighbor being excessively loud and threatening physical violence against me. I have told the landlord several times that I feared violence but nothing was done until the last week when the landlord asked the neighbor to leave because they were behind on rent. I have witnesses and several pictures of a lot of blood on my face, sidewalk and door. The police have not arrested her yet and I would like to know if there is a possibility of a civil case against the landlord. I can provide more detail upon request.

Possible action exists against Landlord for not taking proper action to rid community of dangerous neighbor, but it is a facts and circumstances test and not as clear as you necessarily want it to be. Also, value of that claim involves the permanent nature of your injuries. If they have healed, than value is limited. You have a right of action against the neighbor the assault, assuming you can prove that she did it. The value of that claim involves the permanent injury as well. Have you gotten a restraining order against the neighbor? If you have two incidents involving violence, you should consider getting that now.
