Legal Question in Personal Injury in Florida

I was driving on a main road and another car came through a parking lot, through parking spaces and hit my car doing much damage. This is a no fault state but can I make them pay to either have my car fixed to where it was before or another car if decided totaled? This is if the insurance company will only pay blue book value and not blue book by milieage .My car is a 2001 but has aprox 50,000 miles on it . I kept this car up in good condition..This is my first accident.

You need an attorney who is familiar with no fault auto insurance. This is a very complex area of law. You are likely to be entitled to substantially more than your insurance company is offering. Additionally, the other driver may be liable for your deductable under tort liability. Don't sign anything without having it reviewed by a lawyer.

Do not deal with your insurance company. You have a claim against the other company for rental and the fair market value of your car. No fault does not apply to this situation. If you were injured, see a lawyer. Want to know the law without going to law school? Protect yourself against ripoffs?
