Legal Question in Personal Injury in Florida
Feb 9th 2011 my 17 year old son hurt his hand at a basketball game. The next day he had an appointment with a neuroligist for migranes. He saw his hand and ordered xrays. My wife and my son waited a couple of hours fro the WET results. They were told that everything was fine and just a bad bruise. We assumed it would be sent to our doctor. After a couple of weeks his coach told him to check again. I called our doctor and he had not seen the xray. once he read it he ordered another and referred us a hand surgeon. Apparantly there is a fracture of his ring and pinky bones in his hand. If it woild have been taken care of back when it happened, it would have been reset the cast and healed . Now we need surguery. Am I out of line to ask for accountability?

No, but this is a little more difficult than you may think. In order to have accountability, you need to demonstate that the fracture was there initially (which apparently you have) and that it did not require surgery at that time. You will need a good orthopedic surgeon to back you up on this. Be prepared for the doctors insuance co to say that surgery was necessary from day one.
