In Circuit Court in Florida, you will need to prepare a Complaint that states the elements of the particular cause of action that you have. You will also need to fill out a Civil Cover Sheet which is available at the Clerk of Court's office. You will need a Summons to be served, along with a copy of the Compaint on the defendant(s). Lastly, you will need to pay a filing fee which can vary depending on the exact nature of your cause of action. The Clerk of the Circuit Court can give procedural advice but not legal substantive advice. While an individual can easily navigate Small Claim Court, Circuit Court can be pretty complicated and most people will need a lawyer to assist them. Good luck with your case.
