FL auto accident being personally sued

Was in a rear end accident. No damage to plaintiff car, officer wrote $50.00 damage to my car. I was not ticketed, he stopped for no reason in middle of road. I am being sued personally 3.5 years later for $15 K. I have $250K in coverage. Why is he suing me instead of the insurance company? Isn't that why I have the insurance in the first place, so I don't have to pay for phony damages?

In Florida you are not allowed to sue the insurance company. The legislature changed the law some years ago. The plaintiff sues you, but the insurance company will provide a defense for you, hire an attorney, and will pay any judgment up to your $250,000 of coverage.

Contact your insurance company and forward them the copy of the paperwork you were served. You apparently are being suied for more than 15k which is an allegation that has to be made to be in Circuit Civil Court.
