Legal Question in Personal Injury in Florida

In Florida, can a driiver of a company owned vehicle be sued for negligence in an accident if not found at fault or ticketed at time of accident. The other vehicle had no working lights as noted on fhp report and it came to an abrupt slowing and right turn into a driveway in front of the company vehicle, during a heavy rain, causing the inability to stop in time and collide with the front vehicle that had no lights.

Yes. Anyone can be sued. That doesn't mean there is merit to the claim.

The issuance of a traffic ticket is only evidence of negligence. The absence does not disprove it. Traffic standards are different than negligence standards. Following too closely and being unable to stop can be negligent especially uber difficult driving conditions. Seek legal advice.
