Hit by driver without insurance
I was struck by an 18 year old driver without car insurance. The car is owned by his stepmother. My truck was totaled and the attorney that was handling the case dropped it and said my only recourse would be to file in small claims court. Unfortunately the limit in Fla. is 5000. My bills and loss exceed this. Is there any other remedy or is there a way I can sue separately for my car and medical bills.

You may be able to file suit against the owner (stepmother) and the driver in county court (more than $5000 and less than $15,000) or circuit court (more than $15,000) to seek a final judgment that would allow you to attempt to recover money as a result of the property damage, but I would need to know more about the facts of the case before giving you any meaningful guidance or advice that you could rely on.
