Legal Question in Personal Injury in Florida
I got hit by a drunk driver and their insurance wants to "repair" my brand new car not replace anything. The insurance says that I would have to pay in order to get new parts. Should I take legal action? This is a brand new 2011 car less than 6 months old.

There may be additional penalties against the drunk driver if it was indeed proven that he was drunk. You may wish to consult with an attorney for this. Also, when repairing a car, you should be able to demand that OEM parts be used in the repair. Good luck.
