Hit and Run Unattended Vehicle
On 2/18/00 my 2 week old 2000 Toyota Echo was parked and unattended in front of my house and the car was rearended and pushed across the street and down one house. The individual who lives in the house where the car ended up ran out and observed the responsible individual driving away. When the witness yelled to the suspect to stop they sped up and continued to drive away. A police report was filed at approximately 9:30am on that same day. At approximately 4:00 that afternoon, a man knocked on our front door and indicated that the responsible individual was his 77 year old mother and that she had had a stroke. What we do not know is what time his mother was admitted to the hospital and if that would have any baring regarding this situation.
I am in the process of having the damages assessed for repair, for which I do not feel I should have to pay any money out of my pocket. I am curious as to what legal rights I might have in a situation such as this?

You should not have to pay anything out of pocket, including a rental car while yours is in the shop. There are two potentially responsible parties. The first is the driver, Mom; if she has car insurance in her own name it should pay for the repairs and a rental car. If she does not have insurance then the owner of the car should pay. The fact that Mom had a stroke and continued to drive does not come into the situation. Good Luck
