Legal Question in Personal Injury in Florida
My husband works nights, and accidentally fell asleep at the wheel one morning. Hit hit a small car, estimated damage of $1,000. My husband went on to hit a concrete barrier after that and totalled his car. He recieved a brain injury with bleeding on the brain and doesn't remember anything at all about the accident.
Today, after almost 3 months, he is finally healing, though he still doesn't remember the accident and has memory issues in other areas. We just received notice that we're being sued for medical and lost wages (though the other party are Canadian and reside in a retirement community), so I'm not understanding the "wage" part of the lawsuit.
We're a struggling family of 7 with very little money to spare. What happens if you cannot pay? Just what happens? We were stressed enough before all this.

Your insurance company should defend you and should be taking care of this for you. Contact them to see what they are doing. The lost wages may be just standard language rather than an actual count, and will likely be dismissed. I wish you all the best and hope your husband gets back to normal. Based on my experience with brain injuries, I doubt your husband will ever remember what actually happened before the accident or during the accident. Was your husband on his way to or from his job when the accident happened? Is there any coverage you could obtain from his employer? Was he in an employer's vehicle?
