Legal Question in Personal Injury in Florida

husbands injury

my husband fell off a ladder do to someone taking down studs in a wall and putting them back incorrectly. This person was not a carpenter just a delivery man delivering dry wall. He removed the studs also. My husband broke his leg and needed surgery to repair it . There is no workmens comp. he is self employed. do we have a legal case to recoop bills and lost of work.
