Legal Question in Personal Injury in Florida
Iam a truck driver.The company I work for hauls mail for the USPS in Miami,Fl.
I was working at post office in Miami.I had backed my truck into the dock and was exiting the vehicle.I had stepped onto the bottom step of the truck and had put my right foot on the ground .There is an apx 8 to 10 in drop in the drive way at this dock .My foot touched the ground and I thought I was on solid ground and as I started to bring my other foot off the truck I lost my balance because there was nothing under my heel on my right foot as that is where the drop is.I landed on my head and cut and lacerated it sevearly,requiring an ambulance ride and 5 stiches to my head. This area is not specifically lighted or highlighted at night.Do I have a right to question the safety of this?

You have a worker's compensation claim but it is unclear whether it is a State or Federal claim. You say you work for a company that hauls for the USPS. If that means the company you work for is a private company, you likely have a State w/c claim you can pursue. If you are an employee of the USPS or the Federal government you are limited to a Federal W/C claim. You need to seek legal help either way, but different lawyers handle these different types of claims. If the dock where you were working is owned by the USPS you likely don't have a personal injury claim no matter whose employee you were at that moment. If the dock is owned by some third party then you may have a claim you can pursue. you need an attorney to review the matter.
