Legal Question in Personal Injury in Florida

Infidelity and contraction of a sexually transmitted disease.

I terminated a 4 year relationship when I became aware

of my boyfriend's infidelity. Since then I have been

diagnosed with an uncurable STD that often leads to

cases of cervical and ovarian cancer. (He has been my

only partner.) Do have any course of action to take in

terms of medical bills or emotional distress? Is

defamation of character involved if this information is

spread?

You would have to prove he knew of his condition before his relations with you. Your sex life would be in issue since he would try to prove you caught the condition from someone else. If you could not prove the truth of your statements it may be defamation. If you can prove it he would be responsible for money damages and medical costs. Good luck.

I believe you may have a claim against him, however, more information is needed to evaluate your damages.

It's very touchy. One is that you were in a consensual sexual relationship with him. You were not married to him. You would be bringing forth the suit so defamation would be limited because you may make it public by the suit itself. Monetary claims would be based on whether he alone caused the damages offset by any contribution you may have had. Hard to predict where a jury would stand on these issues.
