Legal Question in Personal Injury in Florida

Injury at the store

Today my husband fell at Home Depot, broke 3 teeth, and needed stiches. I need to find if the store neglected safey caution to protect customers. What step should I take to clarify my concern?

Re: Injury at the store

Sorry to hear of your husband's unfortunate accident. A few questions, if I may. First, did your husband report the accident? If so, did he prepare or take part in preparing an accident report? Did the paramedics come and take him to the hospital? All of the above questions go to the issue of documentation for what caused the fall. The cause of the fall will determine whether there is actionable negligence on the part of the store, which would form the basis of a claim or lawsuit. We would need more facts to better evaluate the potential case against the store. Our office has over 20 years of experience in handling these cases for victims of falls, and will be happy to evaluate this for you, including, if it justifies it, sending an accident engineer or architect to the store to more fully investigate the cause of the fall. Please feel free to contact our offices for a full and complete evaluation of your case.

Re: Injury at the store

If the hazardous condition that caused your husband to fall still exists, go back to the scene and take photographs. It is possible that the store did neglect safety provisions, but it depends if they knew, or should have known, of the hazardous condition that caused the fall.

Feel free to call me if you would like to discuss further.

Re: Injury at the store

need a bit more information as to how the injury occurred to determine if the accident was your husband's fault, the store's fault for violating some duty, or a combination of both.

Please feel free to email me at [email protected] if you have any questions.

Nicolas
